1. Introduction

Digital Asset Tracking Systems, Inc. ("D.A.T.S.," "we," "us," or "our") provides GPS tracking and asset management solutions through our website at www.datsgps.com, our web-based applications, and our mobile applications (collectively, the "Services").

This Privacy Policy explains how we collect, use, disclose, and safeguard information when you visit our website or use our web and mobile applications. By using the Services, you agree to the practices described in this policy.

2. Information We Collect

Information you provide to us

  • Account information: name, company name, email address, phone number, mailing address, and login credentials.
  • Billing information: billing contact and address. Payment card details are processed by our third-party payment processor and are not stored on our servers.
  • Support communications: any information you provide when you contact us, including the content of your messages.

Information collected automatically

  • Device information: device type, operating system, browser type and version, unique device identifiers, IP address, and language settings.
  • Usage information: pages viewed, features used, dates and times of access, referring URLs, and similar diagnostic data.
  • Log data: server logs that may include IP address, access times, and error reports.

Information from our tracking hardware

Our GPS tracking devices, when installed on vehicles or equipment owned or operated by you or your organization, transmit data including location coordinates, speed, heading, ignition state, mileage, and event triggers (such as hard braking or geozone entry/exit) to our servers.

3. Location Data

Our Services collect precise location information from GPS tracking devices and, where you enable it, from mobile devices running our applications.

  • From tracking hardware: location is reported at regular intervals (typically every 1–5 minutes for powered units, and 1–2 times daily for battery-operated units).
  • From mobile devices: if you enable location services in our mobile app, we may collect your device's location to display assets on the map relative to your position, to support field workflows, or to provide location-based alerts.
  • Control: you can disable mobile-device location collection at any time through your device's operating system permissions. Disabling location services may limit certain features.

Location data is used to operate the Services for the account holder. We do not sell precise location data to third parties.

4. Mobile App Permissions

Our mobile applications may request the following device permissions. Each is used only for the stated purpose and may be revoked at any time through your device settings.

  • Location: to display your position on the map and provide location-based features.
  • Camera: to scan barcodes or QR codes on assets (CUROpro), and for capturing photos attached to work orders.
  • Storage / Files: to attach documents to records and to cache map and asset data for offline use.
  • Notifications: to deliver alerts such as geozone events, maintenance reminders, and panic-button activations.
  • Network state: to detect connectivity and synchronize data when online.

5. How We Use Information

  • To provide, operate, and maintain the Services.
  • To deliver maps, reports, alerts, and other features you have requested.
  • To process transactions and send related information, including invoices and renewal notices.
  • To respond to support requests and provide customer service.
  • To send administrative messages such as updates, security alerts, and policy changes.
  • To monitor and analyze usage and trends to improve the Services.
  • To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity.
  • To comply with legal obligations and enforce our terms.

6. Sharing and Disclosure

We do not sell personal information. We share information only in the following limited circumstances:

  • With your organization: if you use the Services through an employer or other organization, that organization is the account holder and has access to the data generated by the assets, devices, and users on its account.
  • Service providers: with vendors who perform services on our behalf, such as cloud hosting, cellular data transmission, mapping services, email delivery, and payment processing. These providers are contractually obligated to protect the information and use it only for the services they provide to us.
  • Legal requirements: when required by law, subpoena, court order, or other legal process, or to protect the rights, property, or safety of D.A.T.S., our customers, or others.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction.
  • With your consent: in any other case where you direct us to share information.

7. Data Retention

We retain information for as long as your account is active or as needed to provide the Services. Location and event history may be retained for the period specified in your service plan, after which it may be archived or deleted. We may retain certain information as required by law, to resolve disputes, or to enforce our agreements.

8. Security

We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, and destruction. These measures include encrypted data transmission, access controls, and regular security review of our systems.

No method of transmission over the internet or method of electronic storage is completely secure. While we strive to protect information, we cannot guarantee absolute security.

9. Your Rights

Depending on your location, you may have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate or incomplete information.
  • Request deletion of your personal information.
  • Object to or restrict certain types of processing.
  • Request a copy of your information in a portable format.
  • Withdraw consent where processing is based on consent.

10. Cookies and Tracking Technologies

Our website and web application use cookies and similar technologies to keep you signed in, remember your preferences, analyze traffic, and improve the Services. You can control cookies through your browser settings. Disabling cookies may limit some functionality, such as staying signed in across sessions.

11. Third-Party Services

The Services use third-party providers including, where applicable, Google Maps for map rendering and routing, cellular carriers for device data transmission, and standard cloud hosting providers. Use of these providers is subject to their own privacy policies.

Our applications may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties.

12. Children's Privacy

The Services are intended for business and government users and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn we have collected such information without verified parental consent, we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Effective date" at the top of this page. For material changes, we will provide additional notice, such as an in-app message or email. Your continued use of the Services after a change takes effect constitutes acceptance of the updated policy.
